Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of CoverageCalls.com and any related services, including inbound call delivery, lead data, and related marketing services (collectively, the "Services") provided by CoverageCalls ("CoverageCalls," "we," "us," or "our"). By accessing the site or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility & Licensing

The Services are intended for U.S.-based insurance agencies, call centers, and licensed agents engaged in the lawful sale of Final Expense and related insurance products. You represent and warrant that you and your agents hold all required licenses, appointments, and authorizations in every jurisdiction where you contact consumers or transact business, and that you will maintain them throughout your use of the Services.

3. Inbound Calls & Lead Data

• Calls and lead data are delivered on the terms agreed in your order, insertion order, or written agreement with CoverageCalls.
• Calls are originated from consumers who have requested information about Final Expense burial insurance under express written consent.
• You are solely responsible for how you handle, route, contact, store, and dispose of calls and consumer data after delivery.
• Return, credit, and dispute policies are governed by your order; absent a written policy, all sales are final.

4. Compliance Obligations

You agree to comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), federal and state Do Not Call rules, state insurance regulations, CAN-SPAM, and applicable privacy laws. You will maintain your own internal Do Not Call list, honor opt-out requests promptly, and use calls only for the purpose for which the consumer requested information.

5. Acceptable Use

• Do not resell, redistribute, or share delivered calls or lead data without our written consent.
• Do not use the Services for fraud, harassment, deceptive practices, or any unlawful purpose.
• Do not attempt to reverse engineer, scrape, or interfere with the Services or our systems.
• Do not misrepresent your identity, licensing, or affiliation with CoverageCalls.

6. Fees & Payment

Fees, billing cycles, and prepayment requirements are set in your order or written agreement. Unless stated otherwise, all amounts are in U.S. dollars and are non-refundable. We may suspend or terminate Services for non-payment or chargebacks.

7. Intellectual Property

CoverageCalls, the CoverageCalls logo, the site content, and the Services are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services solely as permitted by these Terms.

8. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant any specific call volume, conversion rate, contact rate, or business outcome. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, CoverageCalls and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to the Services. Our aggregate liability arising out of or related to the Services shall not exceed the amounts paid by you to CoverageCalls in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless CoverageCalls and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of delivered calls or lead data; (b) your violation of TCPA, DNC, state insurance, or other applicable laws; (c) your breach of these Terms; or (d) your products, services, or representations to consumers.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, including for breach of these Terms or suspected unlawful conduct. Sections that by their nature should survive termination will survive.

12. Governing Law & Disputes

These Terms are governed by the laws of the United States and the state in which CoverageCalls is principally headquartered, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction and venue there.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
